Gold Engine
PRIVATE DEVELOPMENT DRAFT - NOT YET IN FORCE

Gold Engine Performance Fees, Cancellation and Refunds

Last updated: [INSERT DATE]

Drewbz Gold Engine is in private development and commercial access is not currently open. This draft describes the intended commercial model for pre-launch review. It does not create a current payment obligation or right to access the service.

01

Scope

This policy explains the intended performance fees, invoice deadlines, cancellation rules and refund position for Drewbz Gold Engine.

It should be read together with the Gold Engine Service Terms, Gold Engine Risk Disclosure, Privacy Policy and the client's final onboarding confirmation or Service Order.

02

No application or setup fee

Joining a waiting list, submitting an enquiry or applying for future access is free.

There is no setup fee under the current intended commercial model.

Submitting an application does not guarantee acceptance and does not create a payment obligation.

03

No minimum contract term

There is no minimum contract length under the current intended commercial model.

A client may request cancellation at any time, subject to:

  • fees already earned or invoiced;
  • a final performance calculation;
  • safe handling and reconciliation of any open position; and
  • any statutory cancellation rights.
04

Regular-broker performance fee

For an approved regular-broker account, the performance fee is:

10% of feeable net new realised profit above the account's adjusted high-water mark.

The calculation period runs from the 1st to the final calendar day of each month in the billing time zone confirmed during onboarding. If no billing time zone is stated, Europe/London will apply.

Only closed and settled account results are included. Floating profit and floating loss are excluded.

05

High-water mark

The high-water mark prevents a performance fee from being charged again on the same account growth or while the account is recovering previous losses.

The initial high-water mark will normally be the approved settled account balance when the service begins, adjusted where needed to exclude unrelated capital movements or prior activity.

For each calculation:

  1. The previous high-water mark is identified.
  2. The high-water mark is adjusted pound-for-pound for deposits and withdrawals that are not trading profit or loss.
  3. The closing settled balance is compared with the adjusted high-water mark.
  4. Only the positive difference representing net new realised trading profit is feeable.
  5. The performance fee is 10% of that feeable amount.
  6. If the closing settled balance does not exceed the adjusted high-water mark, no regular-broker performance fee is due.
  7. After a positive calculation, the high-water mark is updated to prevent the same profit being charged again.

Deposits do not count as profit. Withdrawals do not remove the requirement to recover prior losses before a new performance fee becomes due.

06

Trading costs and currency

Regular-broker performance is calculated from settled account records after broker trading costs reflected in the account, including relevant commissions, swaps and closed-trade charges.

Where the account or invoice currency differs, the conversion method and source will be stated during onboarding or on the invoice. Reasonable payment-provider or bank charges are not deducted from the performance fee unless required by law or expressly agreed.

Personal tax is not deducted from the calculation.

07

Manual trades and other account activity

The client must not place manual trades or run another automated or copy-trading service on the connected account unless Drewbz Trading has approved it in writing.

If unauthorised activity occurs:

  • the service may be suspended;
  • Drewbz Trading may use broker records to separate Gold Engine activity where this can be done reliably;
  • no disputed profit should be charged until the account has been reconciled; and
  • if activity cannot be separated safely, the parties must resolve the account record before a final fee is confirmed.

Deposits, withdrawals, broker corrections, rebates and non-trading credits will be treated according to their substance and must not be misrepresented as trading profit.

08

Mid-month start

If regular-broker service begins after the 1st of a month, the first calculation period runs from the confirmed service start time to the final calendar day of that month.

The opening settled balance and initial high-water mark will be recorded during onboarding.

09

Regular-broker month-end invoice

After the final calendar day of each month, Drewbz Trading will reconcile the account and issue an invoice where a performance fee is due.

The calculation should show, in a clear form:

  • the calculation period;
  • the opening or prior high-water mark;
  • relevant deposits and withdrawals;
  • the closing settled balance;
  • feeable net new realised profit;
  • the 10% fee; and
  • the payment deadline.

A reasonable reconciliation delay may be needed where broker records, open positions or account activity remain unresolved.

10

Prop-firm performance fee

For an approved prop-firm account, the performance fee is:

10% of each trading payout actually received by the client from the prop firm.

The fee is based on the amount the prop firm or its payment processor pays to the client after the prop firm's own payout split or deductions, but before the client's personal tax or ordinary bank charges.

A separately identified refund, rebate or reimbursement that is not a trading payout is not treated as trading profit unless the final onboarding agreement states otherwise.

Challenge fees, reset fees, platform fees and other prop-firm costs remain the client's responsibility and do not reduce the 10% performance fee unless Drewbz Trading agrees otherwise in writing.

11

Proof of prop-firm payout

The client must notify Drewbz Trading promptly after a payout is approved or received and provide reasonable evidence when requested.

Evidence may include:

  • a prop-firm payout statement;
  • a dashboard record;
  • a payment-provider confirmation; or
  • a bank or wallet record showing the received amount.

The client may redact unrelated transactions, but the evidence must be sufficient to confirm the payout amount and date.

12

Prop-firm invoice

Drewbz Trading will issue an invoice after the payout is received or reliably confirmed.

The invoice will show:

  • the prop-firm payout amount;
  • the 10% performance fee;
  • the invoice date; and
  • the payment deadline.

A later loss, account breach, payout reversal or prop-firm closure does not automatically refund a correctly calculated fee on a payout already received, except where the fee itself was calculated incorrectly or the law requires otherwise.

13

Payment deadline

Every Gold Engine invoice is due within three calendar days of issue.

The deadline is calculated using the date and time shown on the invoice. If a payment method fails, the client remains responsible for arranging payment before the deadline.

The client should contact Drewbz Trading promptly if an invoice appears incorrect. Raising a genuine calculation query does not permit the client to hide account records or ignore the issue.

14

Non-payment

If payment is not received within three calendar days:

  • new trade entries may be disabled;
  • service access may be suspended or revoked;
  • the account connection may be restricted or disconnected;
  • reactivation may require a new account check; and
  • the unpaid invoice remains due.

Suspension does not guarantee immediate closure of an open position. Existing exposure may remain until the position closes and is reconciled under the applicable operating procedure.

Drewbz Trading may take lawful steps to recover an undisputed overdue amount.

15

Cancellation by the client

The client may request cancellation at any time by using the cancellation method stated during onboarding or by contacting:

drewbztrading@protonmail.com

Cancellation becomes operationally effective when Drewbz Trading acknowledges the request and disables new entries or disconnects the account safely.

The client remains responsible for:

  • invoices already issued;
  • regular-broker performance accrued up to the effective termination calculation;
  • a fee on any later prop-firm payout attributable to Gold Engine trading before cancellation; and
  • resolving any open or uncertain account state.
16

Final regular-broker calculation

When regular-broker service ends, Drewbz Trading will perform a final calculation from the last completed billing point to the effective termination point.

Only closed and settled results are included.

If an attributable position remains open, the final calculation may be delayed until that position closes and settles. Floating profit is not invoiced as realised profit.

The high-water-mark rule continues to apply. Cancellation does not create a fee where the account has not made net new realised profit above the adjusted high-water mark.

17

Cancellation by Drewbz Trading

Drewbz Trading may suspend or terminate future access under the Service Terms, including for:

  • non-payment;
  • client interference;
  • false or missing information;
  • unsupported account changes;
  • unsafe or unverifiable account state;
  • security concerns;
  • broker or prop-firm incompatibility;
  • legal or regulatory concerns; or
  • withdrawal of the service.

Termination by Drewbz Trading does not remove a correctly accrued or invoiced fee.

18

Statutory cancellation rights

Nothing in this policy removes a statutory consumer right.

Where a consumer has a legal cancellation period for an online service contract, the final onboarding process will provide the required information and cancellation method.

If the consumer expressly asks Drewbz Trading to begin the service during a statutory cancellation period, the consumer may be required to pay a proportionate amount for service supplied before cancellation where the law permits and the required request and information have been provided.

Because the intended Gold Engine fee is performance-based rather than an upfront subscription or setup charge, the final consumer process must state clearly how any performance generated during an early-start period will be treated.

19

Refunds and corrections

A performance fee is normally charged only after the relevant realised profit or prop-firm payout has occurred. It is therefore not refundable merely because:

  • the account later loses money;
  • a later month is unprofitable;
  • a prop-firm account later fails;
  • the client does not achieve a target;
  • the client changes their mind after the fee became due; or
  • the client stops using the service.

A refund or account credit will be provided where appropriate if:

  • the same invoice was paid twice;
  • the invoice used an incorrect account figure;
  • a deposit was mistakenly treated as trading profit;
  • the fee was calculated above the agreed 10%;
  • Drewbz Trading agrees that the fee was not due; or
  • applicable law requires a refund.

Refunds will normally be returned using the original payment method where practical. Processing times depend on the payment provider and bank.

20

Trading losses are not refundable

Drewbz Trading does not reimburse trading losses, prop-firm challenge fees, reset fees, missed opportunities, failed payouts or account breaches merely because the client used the service.

The performance fee does not make Drewbz Trading an insurer or loss-sharing counterparty.

21

Invoice disputes

A client who believes an invoice is wrong should contact Drewbz Trading as soon as reasonably possible and provide the relevant account or payout evidence.

Drewbz Trading will review the calculation and provide a corrected invoice or explanation where appropriate.

This process does not restrict any statutory right, chargeback right, complaint right or legal remedy that cannot lawfully be excluded.

22

Taxes

The client is responsible for their own tax, reporting and accounting obligations relating to trading profits, prop-firm payouts and service fees.

Drewbz Trading does not provide tax advice.

23

Changes to this policy

The final policy may be updated where reasonably required for legal, regulatory, payment, operational or service changes.

Material changes affecting an active client will be communicated before they take effect where required.
